THE PHOBIA SPECIALIST – TERMS & CONDITIONS

INTRODUCTION

This document outlines the terms and conditions for the provision of coaching and hypnotherapy services by The Phobia Specialist, operated by Filipe Rodrigues. By engaging with our services, you, the Client, acknowledge and agree to adhere to these terms, which constitute a binding agreement between you and The Phobia Specialist. We reserve the right to modify these terms at any time, with any changes becoming effective immediately upon posting on our website. If you disagree with any part of these terms, please refrain from using our services.

ABOUT FILIPE

Filipe Rodrigues is a certified clinical hypnotherapist and psychotherapist, registered with the National Council for Hypnotherapy and accredited by the UK government’s Complementary & Natural Healthcare Council (CNHC).

SERVICES

  1. Filipe Rodrigues provides therapy services tailored to each client’s needs, utilising techniques such as coaching, SFBT, CBT, NLP, and hypnosis to address issues like phobias and OCD.
  2. Clients may be instructed in visualisation techniques or provided with supplementary materials to aid their progress.
  3. It is the Client’s responsibility to follow guidance and utilise the provided tools as part of their treatment.
  4. Recording of sessions without prior consent from Filipe Rodrigues is strictly prohibited.
  5. No guarantees of treatment success are provided.
  6. Filipe Rodrigues is not medically trained and makes no claims to be medically trained.
  • You must not rely on the information on our website or in sessions as an alternative to medical advice from your doctor or other professional healthcare provider.
  • Consult your doctor if you have any specific questions about a medical matter.
  • If you suspect you may be suffering from a medical condition, seek immediate medical attention.
  • Never delay or disregard medical advice because of information from our service.

CLIENT REQUIREMENTS

  1. Clients must be 18 years or older.
  2. The Phobia Specialist is not liable for third-party privacy and security.
  3. Sessions are conducted online via Microsoft Teams.
  4. Clients must ensure they have the necessary technology and internet connection.
  5. Clients are responsible for minimising distractions during sessions.
  6. Sessions must not include other individuals without prior consent.
  7. Therapy cannot be provided to individuals who currently suffer from, have a history of, or have been diagnosed with:
    • a Personality Disorder
    • Schizophrenia, Psychosis, or Delusional symptoms
  8. Clients must be sober during sessions.
  9. Punctuality is required for all sessions.
  10. Results vary; no refunds are offered for completed sessions.
  11. Clients must not be resident in the United States or Canada.

CONFIDENTIALITY

  1. Filipe will keep all client information confidential and will never disclose information without explicit consent, except in the following circumstances:
    • Where there is a risk of harm to the client or others.
    • Where there are safeguarding or child protection concerns.
    • If required to do so by a court order.
  2. Any case studies shared professionally will be fully anonymised.

SESSION TRANSCRIPTION AND SUMMARIES

To enhance the quality of our services and provide accurate session summaries, we may transcribe sessions using secure third-party software, such as Krisp. These transcriptions are used solely for note-taking, producing session summaries, and improving client support. All data is processed in accordance with applicable data protection laws, including UK GDPR. By agreeing to these terms, you consent to the transcription and summarisation of your sessions unless you inform us otherwise in writing.

PAYMENTS, CANCELLATIONS, REFUNDS, FEES AND RESCHEDULING

  1. Payment is required in full before the first session via Stripe.
  2. By completing payment, the Client agrees to these terms, our privacy policy, and Stripe’s privacy policy.
  3. Refunds (minus a 5% administrative fee) are available up to 48 hours before the first session.
  4. Clients commit to agreed appointment times.
  5. Sessions may be rescheduled with at least 24 hours’ notice.
  6. Fees are subject to change with prior notice, but changes will not affect already booked sessions.
  7. Client data is handled in compliance with UK GDPR and our privacy policy.
  8. Filipe Rodrigues reserves the right to refuse therapy at his professional discretion. Any unused sessions will be refunded accordingly.

LIABILITY

  1. The Phobia Specialist is not liable for losses or damages beyond legal obligations.
  2. Filipe Rodrigues is not liable for direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or data.
  3. The services are provided “as is”, without warranties of any kind, express or implied.
  4. Nothing in these Terms affects your statutory rights.

FORCE MAJEURE

Neither party shall be held liable for failure to perform due to events beyond their reasonable control.

GOVERNING LAW

These terms are governed by the laws of England and Wales. Any disputes shall fall under the jurisdiction of English and Welsh courts.
